There are two options open to borrowers. They can either claim the full amount of the credit card charges they’ve incurred, or the difference between the actual charge and the OFT recommended fee of £12.
For example, a charge of £35 minus £12 would give a refund of £23.
Reclaiming the excess amount over £12 is more likely to be successful than asking for the full refund.
However, many people have succeeded in claiming the full charge back (especially for credit car charges pre-June 2006) as most companies prefer paying up in order to avoid having to justify their charges in court.
Customers that start by claiming the full charge can always fall back to the difference between £12 and what they were actually charged later on.
